Ética pública: o diálogo entre os princípios da administração pública e as políticas de compliance na gestão pública

Abstract

The present work carried out a theoretical-conceptual approach to the question of ethics in the public service, focusing on the dialogue between the constitutional principles of the administration and the compliance policies in Brazilian public management. The study was permeated by the analysis of compliance policies in the context of Public Management from the scientific production on the subject. It discusses how the adoption of compliance policies can be useful in the fight against corruption in the public arena, contributing to good governance practices, as well as the concepts of ethics management and its approaches and presents concepts related to the constitutional principles of public administration. The study found that ethics is directly related to the constitutional principles of public administration, which support the moral values of good conduct and governance. Public compliance, however, includes the public integrity program, whose purpose is to identify and correct any deviations, illicit acts, fraud and irregularities, as well as to combat and protect the public body against corruption. The consequent reduction of incidences of ethical deviations and corrupt practices generates greater credibility to the adhering companies and greater reliability to their future businesses. Based on these concepts, it was possible to conclude that public compliance is indispensable to combat and eradicate systemic corruption in the Brazilian public sector. The research data corroborate to reinforce the relevance of the theme and the importance of the planning and implementation of public compliance within the Brazilian political spheres. In this way, ethics in public administration can and should be stimulated with public agents, leading to a change of behavior that must be felt by the community.
