Audiência pública: um momento para o exercício da democracia

Abstract

Citizen participation has gained importance with the enactment of the Magna Carta in 1988. The Constitution has a unique importance to citizenship, ruling in his text reaffirms various devices such importance. Participatory management has become a recognized figure and at the public hearing that has its own space where it will be put into practice that commandment, contributing to the development and implementation of our public policies. The legitimacy of the actions taken here will contribute to the Public Administration in the making of laws and policies that will be accepted by all. We found in our legislation the use of this instrument of democratic participation, distributed in various segments, such as in urban planning, the preparation of budgets, environmental policy, legislation concerning bids, the sphere of action of the prosecution, the judiciary and the Legislature. When we treat of popular participation are referring to the legitimacy, because a public hearing, all citizens have standing to participate in and contribute suggestions and decision making, which will be decided in those democratic spaces for exchanging experiences. Public hearings should be seen as a result of the development of democratic regimes suffered when there was overcoming that system representative to participatory democracy. This space for the exercise of democracy, channels of dialogue between the Government and the community, will open and citizens democratically can communicate with the Public Administration, sending suggestions, offering criticism and contributing to the strengthening of democracy .
