Análise de custos de processos judiciais devido a patologias

Abstract

The present work seeks to analyze the costs that pathologies can create for the construction companies due to customer dissatisfaction in the after-sales service, considering the responsibility of the construction company to ensure that the property works perfectly within five years. Therefore, the costs of lawsuits due to constructive defects of residential properties were evaluated. The analyzed processes are public, with definite sentence and are of real estate located in the region of Curitiba. As the costs of repairs are not mentioned in value, and considering that the construction company was condemned in some cases to promote the claimed repairs, the quantitative analysis of the costs was made according to the sentenced moral damages and costs of the proceedings. In order for the sentenced value to be more tangible, it was compared to the amount paid in the acquisition of the property, resulting in a percentage. It was proved that the legal costs with payment of indemnities in the evaluated processes exceeded on average 10.0% of the value of the property, directly impacting the estimated profit margin for the evaluated cases.
